These Terms of Service ("Terms") govern your use of the website and services provided by Opsly, powered by Simpson & Associates ("Opsly," "we," "us," or "our"). By signing up for or using our services, you agree to these Terms.
Opsly provides access to an all-in-one business platform including CRM, unified inbox, automations, email campaigns, scheduling, sales pipelines, websites/funnels, and reputation tools, along with account setup and onboarding services.
New accounts require a one-time setup fee of $497. The setup fee includes: two onboarding sessions once your service begins; sales pipeline setup; contact migration (name, phone number, email address, and mailing address); custom domain connection; account setup with your brand colors; and phone number setup with A2P registration if you add texting.
The setup fee does not include automation building or newsletter assistance, which are not part of standard onboarding.
To keep your setup on schedule, you must provide the information needed to build your account within 7 days of your signup date. Delays in providing this information may delay your launch.
Each plan includes monthly credits that cover normal usage such as email notifications and verifications. Usage beyond your included credits is billed at cost.
Text messaging is available for $15/month and includes a dedicated phone line and a monthly text allowance; usage beyond that allowance is billed at cost. Texting requires A2P registration, a carrier compliance step that typically takes several days to a couple of weeks. Texting activates only once registration clears. You are responsible for obtaining proper consent from your own contacts and complying with all applicable messaging laws.
You may cancel your subscription at any time. Cancellation stops future monthly charges; it takes effect at the end of your current billing period. There are no partial or prorated refunds for the remainder of a billing period.
All sales are final. Because setup work and account provisioning begin promptly after signup, the one-time setup fee and all monthly subscription charges are non-refundable.
The Opsly brand, website, and materials we provide remain our property. You retain ownership of the content and data you provide. You grant us the limited rights needed to provide the services to you.
The services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not guarantee that the services will be uninterrupted or error-free.
To the fullest extent permitted by law, Opsly and Simpson & Associates will not be liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim relating to the services will not exceed the amount you paid us in the three months before the claim arose.
You agree to indemnify and hold harmless Opsly and Simpson & Associates from claims arising out of your use of the services, your content, or your violation of these Terms or applicable law.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Florida.
We may update these Terms from time to time. The "Last updated" date above reflects the most recent version. Continued use of the services after changes means you accept the updated Terms.
